Agreement and electronic communications
These Terms form a binding agreement between you and Catering تورنتو. You consent to receive communications from us electronically (including email and notices on the site) relating to your orders and account. You agree that electronic records satisfy any legal requirement that communications be in writing, where applicable. The English and French versions of these Terms are offered for convenience; in the event of a discrepancy, the English version may prevail for interpretive purposes unless mandatory local law requires otherwise.
Our services
Catering تورنتو provides prepared food, beverage coordination as described in your order, and related catering support (such as delivery or drop-off scheduling) as offered on our site and confirmed in writing or at checkout. Menus, photographs, and descriptions are presented for guidance; minor variations may occur based on seasonality, supplier availability, or kitchen execution. Service area, minimum order values, and staffing options are subject to capacity and geographic limits stated at the time you order.
Eligibility and accounts
You must be at least the age of majority in your province or territory of residence, or have verifiable parental or guardian consent, to place orders or create an account. You agree to provide accurate, current information and to update it as needed. You are responsible for safeguarding your login credentials and for all activity under your account. Notify us promptly of any unauthorized use.
Quotes, orders, and acceptance
A quote or cart total is an invitation to contract unless expressly stated otherwise. A binding contract is formed when we confirm your order (by written confirmation, email, or successful completion of checkout, as applicable). We may refuse or cancel orders in good faith where items are unavailable, pricing is manifestly erroneous, fraud is suspected, or we cannot safely fulfill within your requested timeline. If we cancel after payment, we will refund amounts paid for the canceled portion unless a different remedy is required by applicable consumer protection law.
Pricing, taxes, and currency
Prices are quoted in Canadian dollars unless stated otherwise. Harmonized Sales Tax (HST), Goods and Services Tax (GST), Provincial Sales Tax (PST), or other taxes may apply as required by law based on the delivery location and nature of the supply. Delivery fees, service charges, gratuities (where applicable), and equipment rental may be added as disclosed before you confirm payment. Published prices may change until your order is confirmed.
Payment
Payment is due as shown on your invoice or checkout screen. We may use third-party payment processors (such as Stripe); your use of those services is also subject to their terms and privacy policies. You authorize us and our processors to charge your selected payment method for the total amount due. Late payment may result in suspension of fulfillment, interest or administrative fees where permitted by law, and recovery costs. You agree not to initiate illegitimate chargebacks; where a dispute arises, contact us first so we can attempt to resolve it.
Delivery, pickup, and performance
Delivery windows and on-site times are estimates and may be affected by traffic, weather, building access, or other events outside our reasonable control. You are responsible for ensuring venue access, accurate address information, and safe receipt of food. Risk of loss for delivered goods passes to you upon delivery to the location specified in your order, except where mandatory consumer law provides otherwise. If you fail to accept delivery without reasonable cause, additional fees or forfeiture of perishable product may apply as communicated at the time of order.
Cancellations, changes, and refunds
Cancellation and modification policies depend on order lead time, kitchen production commitments, and custom items. Specific fees, cut-off times, and refund eligibility will be stated in your quote, order confirmation, or checkout flow. Generally, late cancellations or same-day changes may incur partial or full charges to cover food cost and labor already committed. Perishable goods may not be returnable once prepared. Nothing in these Terms limits non-waivable rights you may have under Ontario or other applicable consumer protection legislation.
Food safety, allergens, and dietary needs
We follow sound food-safety practices and strive to describe major allergens and dietary attributes accurately. Our kitchen may handle common allergens (including nuts, dairy, gluten, sesame, soy, eggs, and shellfish). Cross-contact can occur. Guests with severe allergies or medical dietary requirements must inform us in writing before the event and should consult qualified medical advice. We are not liable for adverse reactions where we have relied on information you provided or where undisclosed allergies or sensitivities were not communicated in time for us to plan safe alternatives.
Intellectual property and acceptable use
All content on this site—including text, graphics, logos, menus, and layout—is owned by Catering تورنتو or our licensors and is protected by copyright and trademark laws. You receive a limited, non-exclusive, non-transferable license to access the site for personal or internal business use in connection with ordering our services. You may not copy, scrape, reverse engineer, interfere with security, transmit malware, or use the site for unlawful or abusive purposes.
Disclaimer and limitation of liability
To the maximum extent permitted by applicable law, our services and site are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our aggregate liability for any claim arising out of these Terms or our services is limited to the greater of (a) the amount you paid us for the specific order giving rise to the claim, or (b) one hundred Canadian dollars (CAD $100), except where such limitation is prohibited by law (including certain claims under the Consumer Protection Act, 2002 (Ontario) or other statutes that cannot be contracted away).
Governing law, disputes, and general
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law rules. You attorn to the exclusive jurisdiction of the courts located in تورنتو, Ontario, subject to mandatory arbitration or small-claims rules that cannot be waived by agreement. If any provision is held invalid, the remainder remains in effect. These Terms constitute the entire agreement regarding the subject matter here and supersede prior discussions, except for additional written contracts for specific events. We may assign our rights and obligations in connection with a merger or sale of business.
